Terms of Service
These terms describe what you can expect from WhisperX and what we expect from you when you use the service. By installing or using the WhisperX app you agree to them.
1. Eligibility
You must be at least 13 years old. If you are under the age of majority in your jurisdiction, you must have a parent or guardian's permission. If we discover an under‑13 account we will delete it.
2. Your account
Your identity in WhisperX is a cryptographic key pair generated on your device. The server stores only the public half. We cannot recover your account if you lose access to the device that holds the private key — there is no password reset, no support backdoor, no out‑of‑band reset email.
You are responsible for:
- Keeping your unlock PIN private and choosing one that is not trivially guessable.
- Keeping your device physically secure — anyone with physical access to an unlocked device with the app installed can read messages and send as you.
- Verifying contacts using the in‑app safety number / SAS before you treat the channel as MITM‑resistant.
3. Acceptable use
You may not use WhisperX to:
- Distribute child sexual abuse material (CSAM) or content that exploits minors.
- Send messages that violate the laws applicable to you or your recipient.
- Send spam, mass unsolicited messages, or run automation that abuses the rate limits.
- Attempt to compromise other users' accounts, exploit vulnerabilities, or interfere with the operation of the service.
- Reverse‑engineer or modify the app for the purpose of bypassing security controls and then operate the modified client against the production service. (Building it for personal research is fine — it is open behaviour by design.)
We cannot read your messages and we will not attempt to. Reports of abuse must include enough independently observable evidence (for example: screenshots from the receiving device, the sender's public key) for us to act. We can revoke delivery tokens and block public keys at the server level; we cannot retrieve content.
4. The wallet
WhisperX includes an optional non‑custodial wallet. By using it you accept full responsibility for the keys, the seed phrase, and any transactions you originate. We never have custody of your funds and cannot reverse, freeze, or recover transactions. See the Wallet Disclosure for the full disclaimer.
5. Beta status
WhisperX is currently in early beta. The protocol, the on‑disk schema, the server APIs, and the cryptographic envelope format may change in ways that make older clients incompatible. We will not knowingly break a release that has wide adoption, but we also will not maintain backwards compatibility shims that compromise security. Update prompts may be required.
6. Service availability
The service is provided as is, without warranty of any kind. We aim for high uptime but we do not guarantee it. Outages, delivery delays, and dropped calls can and will happen. WhisperX is not a substitute for emergency services — do not use it to call 112, 911, or any other emergency line.
7. Limitation of liability
To the fullest extent permitted by applicable law, WhisperX, its operators, and its contributors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our aggregate liability for any claim is limited to fifty euros (€50) or the amount you paid us in the twelve months preceding the claim, whichever is greater.
8. Termination
You can terminate your account at any time from inside the app (Settings → Danger Zone → Delete Account). We may terminate or suspend your account if you violate these terms, if your usage threatens the integrity of the service, or if a competent authority compels us to do so under applicable law. Termination revokes your delivery tokens; messages already delivered to peers cannot be recalled.
9. Governing law
These terms are governed by the laws of the Republic of Lithuania. Disputes that cannot be resolved informally fall under the jurisdiction of the courts of Vilnius, without prejudice to consumer protection rules of your country of residence within the European Union.
10. Changes to these terms
Material changes will be announced inside the app on next launch. Continued use after a change constitutes acceptance of the revised terms.
